The former Okaloosa County deputy who shot and killed U.S. Air Force Senior Airman Roger Fortson was arrested on Monday in connection with the shooting.

The incident occurred on May 3 after former deputy Eddie Duran, 38, responded to a domestic disturbance report at Fortson’s residence in Fort Walton Beach, Florida, that turned out to be false.

The former deputy now faces a first-degree felony charge of manslaughter with a firearm, which could lead to a 30-year prison sentence, according to The Associated Press.

The arrest comes after an investigation into the incident that found his use of deadly force to be unjustified. Duran shot Fortson multiple times after the airman answered his door while holding a handgun that was pointed toward the ground.

The officer later claimed he feared for his life. He claimed in an internal affairs report that he saw “aggression in the airman’s eyes” and believed he was “about to get shot." After reviewing the incident, investigators determined that Duran’s life was not in immediate danger, which led to his termination from the sheriff’s office on May 31.

The incident occurred after Duran had been dispatched to Fortson’s apartment following a report of a domestic disturbance. Body camera footage that was later released to the public shows Fortson holding his firearm with the muzzle pointed downward as he opened the door. His left hand was raised, palm open, in what seemed to be a gesture of non-aggression. Duran shot the airman within seconds of the door opening.

The incident started with a domestic violence call. The woman who made the call told authorities after the shooting that she heard a woman’s voice coming from the apartment. “Before it was just, usually banter back and forth,” but that on the day of the shooting, it was worse.

But Fortson, who had no criminal record, lived alone and had no guests that afternoon. He was on a video call with his girlfriend, who told investigators they had not been arguing. She said Fortson was playing a video game.

An apartment complex manager called the sheriff’s office at 4:24 p.m. and Duran arrived three minutes later. He met the manager in the parking lot and she directed him to Fortson’s fourth-floor apartment, telling him there are frequent arguments, body camera video shows.

The footage shows Duran knocking on the door and announcing himself. However, he moves out of view of the peephole, meaning Fortson could not see him. He was in the middle of a Facetime call with his girlfriend at the time. He asked who was at the door, but did not seem to hear the officer. He picked up his gun and answered, at which point Duran shot him.

Assistant State Attorney Greg Marcille announced the charges against Duran on Friday and confirmed that the former officer was booked at the county jail on Monday. “He did, in fact, turn himself in,” he told The Associated Press. “He will be held in custody pending his initial appearance.”

Duran’s attorney, Rod Smith, argued for his pre-trial release, saying he posed “no risk, no flight risk” and would “show up anytime” as required. The judge denied the request, citing a new Florida statute mandating custody without bond for those charged with first-degree felonies, according to ABC 7.
